SB 534 -- SUPERVISION IN NURSING HOMES
SPONSOR: Cauthorn (Portwood)
COMMITTEE ACTION: Voted "do pass by consent" by the Committee on
Senior Security by a vote of 18 to 0.
This bill adds two new definitions to the Omnibus Nursing Home
Act:
(1) "protective oversight" is defined as the 24-hour awareness
of the location of a resident and the ability to intervene and
supervise the nutrition, medication, and care of the resident;
and
(2) "voluntary leave" is defined as an off-premise leave
initiated by a competent resident or the legal guardian of an
incompetent resident.
FISCAL NOTE: No impact on state funds.
PROPONENTS: Supporters say that the bill's definitions make
clear when a facility's protective oversight is released. Under
current law, nursing facilities technically must send a staff
member with a resident whenever that resident leaves the
facility.
Testifying for the bill were Representative Stefanick; and
Missouri Assisted Living Association.
OPPONENTS: There was no opposition voiced to the committee.
